Growthgig’s Terms of Service

The following agreement is a legally binding agreement between You (either "Merchant" or "Expert" and Growthgig Community Network (“Growthgig”, "We", or “Us”). This agreement includes the Terms of Service that you must comply with in order to access and use our service. At times, we may update these Terms of Service without direct notification to you. You are responsible for knowing the latest version by visiting the website www.growthgig.com (“Site”).

Please read these Terms of Service (“Terms”) carefully before registering as a user on our Site.
By accessing or using the Site, you agree to be bound by these terms. If you disagree with any part of the terms, you may not access or use the Site.

These terms include:

1. General Terms of Use

1.1 Description of Gigs

Growthgig is an online community that connects experts who look for jobs to earn extra income, with merchants who need to find high-quality human resources with reasonable costs and great efficiency. Growthgig provides online tools and utilities to help experts and merchants manage work, transactions, and payments. We also create a fair environment where the rights of all involved parties are protected. Our services will be referred to as "Gigs". You understand and agree that these gigs will include some contact information of the Growthgig Management Board through communication channels such as email, website, etc. This contact information is considered an integral part of the gigs and you will not be able to refuse to receive this information unless you disable your account on Growthgig.

Growthgig is not an employment service provider, nor employment agency. We only provide utilities for and support the involved parties during transactions.

1.2 Responsibility Towards Account and Password Provided

You will receive a password and an account after completing the registration for using gigs. It is your sole responsibility to protect your password, account and all account activities. You agree to (a) immediately inform us of any unauthorized use of your password, account or any other violation of security, and (b) ensure that you always log out of your account after using. We cannot and will not be responsible for any loss or damage resulting from your failure to comply with this term.

1.3 Responsibilities Towards Providing Information

As a gig user, you must: (a) have a legal capacity and status when using the gig, (b) provide the latest, complete, and accurate information about yourself in Personal Profile, (c) maintain and update your Personal Profile in time to ensure that all information is up-to-date and accurate. If you provide any information that is dishonest or inaccurate, or if we have reasonable grounds to suspect that the information is dishonest or inaccurate, we have the right to suspend or terminate your account; decline partly or all of gig use for the time being or in the future.

1.4 Responsibilities Towards Posting Content

You understand that you are solely responsible for the content you create including, but not limited to data, documents, software, audio, images, videos, and emails. We have no obligation to monitor the posted materials and therefore do not guarantee the legitimacy, accuracy, integrity or quality of such content. In areas where content may be posted, you may share permitted information in our default format and must be solely responsible for the details, information, images and everything else you share with other individual users or groups.

1.5 Limitation on Operation

We may disable your account, remove your information or warn the community of your actions and refuse to provide the service if: (a) you have misused the gigs, committed an unlawful or unethical act (b), we have reasonable grounds to suspect that the information you provided is untrue or inaccurate, (c) we believe your actions are fraudulent, deceiving and may cause financial losses and legal liability to the community or us.

1.6 Limitation on Liability

You understand and agree that: (a) your use of our gigs and transactions on our website is your decision. Besides legal grounds that are based on data stored on our website, you will be responsible for all other risks. We refuse to guarantee the quality of gig or personal prestige of the parties involved. (b) We are under no obligation to handle complaints regarding the quality of gigs provided by the parties, except the transactions made on our website, and refuse all related constraints. (c) We are not responsible for third parties’ services that use our information to provide gigs for you. (d) We do not guarantee that (i) gigs will be uninterrupted, timely, secure or error-free, (ii) gigs will be accessible at any time, (iii) the information, content or advertisements included in the gigs will be accurate or reliable, (iv) the loss of data and other content is secured. (e) We reserve the right to modify, put on hold, or permanently disable the gigs, with or without notice. We are not responsible for any adjustments, suspension or discontinuation of the gigs.

1.7 Security

We do not sell or give your information to third parties outside of Growthgig Community without your permission, and we only use your information as stated in the Privacy Policy. We regard the protection of users’ privacy as a top priority. You may review our current privacy policy in the Privacy Policy.

1.8 Intellectual Property

All intellectual property rights currently in Growthgig’s gigs belong to Growthgig, or licensed for Growthgig’s use. Accordingly, all legal rights are guaranteed. Unless approved by us, you are not permitted to upload, send, publish, modify, reproduce, transfer or distribute our gigs in any form. We reserve all the rights, including but not limited to, copyright, trademarks, and other proprietary rights in our gigs. All elements constituting our gigs are in our possession, whether registered or unregistered. The use of our proprietary rights requires prior written permission from us. Apart from a documented authorization, we do not issue a license in any form, whether it is a form of publication or implication, or by letting you use our gigs. Therefore, you do not have the right to use our gigs for commercial purposes without our prior written permission. You agree to let us use, reveal, apply and adjust any ideas, concepts, ways, suggestions, comments or other forms of notice you provide to us (“Feedback”) related to Growthgig and/or our gigs, at no cost. You give up or agree to give up any right to claim rewards, royalties, fees and/or other forms of payment related to our use, disclosure, application, and/or edit your feedback.

1.9 Complaint and Dispute Settlement

We encourage merchants and experts to try and settle conflicts amongst themselves. If for any reason this fails or if you encounter non-permitted usage on the Site, users can contact Growthgig's Help & Support department for further assistance.

2. Terms for Merchants

By using the gigs on our Site, you agree and accept these Terms for Merchants. Please read carefully the following terms before you start to use the gigs on our Site.

2.1 Merchant Account

The community is comprised of experts from all over the world. In order to maintain a high-quality work environment, all information provided in the user’s account must be truthful and verifiable.

After registration, you are responsible for protecting your password. You should not reveal the password, authorize or allow anyone to use your password for any purpose. We will always consider the act of accessing and using gigs on our Site under someone's name and password their activity, regardless of whether their name and password may be used by others without the owner’s awareness or not.

If you find out about anyone who knows your password or uses your password to access and use our gigs, you need to notify us immediately and change your password or request our help in setting a new password.

2.2 Using The Site

It is not allowed to edit, copy, change or sell any information or gigs belonging to other users on our Site.

2.3 Payments

You should pay as directed by the Site, and notify us should there be any error.

2.4 Security

We do not sell or give your information to third parties outside our system without your permission. We consider protecting user’s privacy as a top priority.

2.5 Feedback and Reviews

Honest and constructive feedback contribute to an efficient work environment. The best reviews are when they provide useful information for both the recipient and the community in general.

We do not monitor, censor, or investigate feedback. However, in some cases, we may remove ratings and reviews if we find a violation of our Terms of Service or the detailed instructions below.

Any action that distorts feedback, forces other users by threatening to give negative feedback, or offering to sell or buy gigs in exchange for positive feedback, is strictly prohibited.

Feedback containing the following contents may be hidden or edited:

  • Spam, advertisements, or other commercial contents.
  • Content that promotes illegal activities.
  • Content about other people.
  • Political, religious, or other social commentaries, rather than a direct comment on work experience.
  • Offensive, obscene, pornographic, defamatory, libelous, threatening, discriminatory, or sexual materials.

2.6 Complaint and Dispute Settlement

We encourage merchants and experts to try and settle conflicts amongst themselves. If for any reason this fails or if you encounter non-permitted usage on the Site, users can contact Growthgig's Help & Support department for further assistance.

2.7 Order Cancellations and Refunds

In the event that a merchant wants to cancel an order, he/she can do so by directly sending a request to the expert. All cancellations must have a valid reason, and must be approved by the expert in order to be effective.

If for any reason both parties fail to reach a consensus, Growthgig will handle the dispute and make the final decision by assessing a number of factors including, but not limited to, reasons to cancel, response time, violations of Growthgig’s Terms of Service, general misconduct, and other improper usage of Growthgig system.

Orders are not to be canceled based on the quality of service/materials delivered by the expert if the service was performed as described in the gig description. Merchants may request to redo the project, or rate their experience and give feedback to the expert in the Workroom page.

If an order is officially canceled, the merchant will receive their funds back in their Growthgig’s account.

3. Terms for Experts

The Growthgig community is comprised of experts all over the world. In order to maintain a high-quality work environment, all information provided in the user’s account must be truthful and verifiable.

  • An expert profile must include personal information and show experience and skills accurately.
  • Profile picture should be clear, or a logo if it’s a company or team. The profile picture cannot contain contact information. Clipart, group photos, or overly edited images are not accepted.
  • Each account belongs to only one person. Accounts are not to be shared or copied in any form.
  • Expert accounts that intentionally show a relationship with Growthgig or any other organization are not accepted.

It is not allowed to edit, copy, change or sell any information or gigs belonging to other users on our Site.

If you find out about anyone who knows your password or uses your password to access and use our gigs, you need to notify us immediately and change your password or request our help in setting a new password.

3.2 Using The Site

3.3 Fees & Payments

3.3.1 Gig price

Gig price is the price for each gig and any additional services that come with it. Gig price is set by the expert and approved by us. After our approval, the expert has the right to adjust their gig price on demand.

3.3.2 Transaction fee

Transaction fee is the amount debited from the expert’s net revenue after an order is completed (is confirmed by the merchant). The current transaction fee is 25% of total gig price, excluding value-added tax (VAT), or also known as goods and services tax (GST). This transaction fee is effective from January 1, 2019. The transaction fee may be adjusted by Growthgig. Each time we adjust the transaction fee, we will announce the new fee and update in the Terms for Experts.

3.3.3 Expert income

Expert income is the amount of money the expert receives after deducting the transaction fee.

3.3.4 Taxes

Experts are responsible for paying any direct or indirect taxes, including any GST, VAT, personal income tax (PIT) or otherwise, which may apply to them depending on residency or location. Experts represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The gig price shown on the gig page is inclusive of all such taxes and charges that may apply to the experts.

3.3.5 Payout for experts

Expert income is transferred to the expert's Growthgig account as soon as the order is confirmed to be complete. The expert can send a withdrawal request for the entire amount in their Growthgig account. Within 7 working days, this withdrawal request will be processed and transferred via PayPal. Experts must pay any PayPal fees where applicable, and Growthgig is not responsible for any changes regarding this fee.

If there are any changes in the payment method and fees, we will notify users and update in the Terms for Experts.

3.4 Security

We do not sell or give your information to third parties outside our system without your permission. We consider protecting user’s privacy as a top priority.
